Terms of Service

These Terms of Service ("Terms") govern your access to and use of RentalTools.net (the "Service") operated by VisionQuest Services LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • You must be at least 18 years old to create an account

2. Description of Service

VisionQuest Services LLC provides an equipment rental management platform that enables businesses to manage their operations, process customer orders, and maintain business records. The Service is provided on a subscription basis.

3. Your Data

  • You retain ownership of all data you enter into the Service, including business information and customer data
  • You grant us a limited license to use your data solely for the purpose of providing and improving the Service
  • You are responsible for the accuracy of data you enter and for obtaining any necessary consents from your customers whose data you process through the Service
  • We handle your data in accordance with our Privacy Policy

4. Your Responsibilities

  • You are responsible for your use of the Service and for ensuring your use complies with applicable laws
  • You are the data controller for your customers' personal information processed through the Service; we act as your data processor
  • You must obtain any required consents from your customers for collection and processing of their data
  • You must not use the Service for any unlawful purpose or in violation of these Terms
  • You must not attempt to gain unauthorized access to the Service or its related systems

5. Administrative Access

Our authorized support personnel may access your account for the purposes of:

  • Providing technical support you have requested
  • Diagnosing and resolving technical issues
  • Ensuring the integrity and security of the Service

All administrative access is logged. Administrators cannot view your password. You will be notified if your password is reset by an administrator.

6. Payment and Subscription

  • Subscription fees are billed monthly or annually in advance
  • All payments are processed securely by Stripe, Inc. We do not store your payment card information
  • You may cancel your subscription at any time; access continues until the end of the current billing period
  • We reserve the right to change pricing with 30 days written notice
  • Refund requests are handled on a case-by-case basis

7. Acceptable Use

You agree not to:

  • Use the Service to transmit harmful, offensive, or illegal content
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Impersonate another person or entity
  • Use the Service to send unsolicited communications (spam)

8. Intellectual Property

  • The Service, including its design, code, features, and documentation, is owned by VisionQuest Services LLC and protected by intellectual property laws
  • Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during the subscription term
  • You retain all rights to your data and content uploaded to the Service

9. Service Availability

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
  • We may perform scheduled maintenance with advance notice
  • We are not liable for downtime caused by factors outside our reasonable control

10. Termination

  • You may terminate your account at any time by contacting us at support@rentaltools.net
  • We may suspend or terminate your access if you violate these Terms
  • Upon termination, you may request an export of your data within 30 days. After that period, your data will be deleted in accordance with our Privacy Policy

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISIONQUEST SERVICES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless VisionQuest Services LLC from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or your violation of these Terms.

14. Dispute Resolution

  • These Terms are governed by the laws of the State of New York
  • Any disputes shall first be addressed through good-faith negotiation
  • If negotiation fails, disputes shall be resolved through binding arbitration in Niagara County, New York, except that either party may seek injunctive relief in court
  • You agree to bring claims only in your individual capacity and not as a class member or representative

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance.
